Female Pilot Prevailed! The 6th Circuit Court of Appeal Agreed that her employer treated her differently than male pilots.

We congratulate our client, Shari Drerup, who prevailed on her appeal in the Sixth Circuit in her sex discrimination lawsuit against her former employer, NetJets Aviation Inc. Ms. Drerup sued NetJets alleging that NetJets terminated her based on her sex in violation of Title VII and Ohio state law. NetJets terminated Ms. Drerup after she was unable to “attain sufficient control authority” of the aircraft (i.e. she was too short to push the rudder all the way down on the Phenom aircraft for which she was hired).

Ms. Drerup argued that the Company discriminated against her or treated her differently than her male coworkers. She contended that NetJets had reassigned three of her male coworkers to fly other aircrafts when they were deemed “too tall” to fly the Phenom, but that NetJets did not offer her the same reassignment opportunity.

The district court granted NetJets’ motion for summary judgment finding that Ms. Drerup’s discrimination claims could not proceed, but the Sixth Circuit disagreed and reversed the lower court noting in relevant part that “Drerup’s height impacts her ability to safely and comfortably fly the plane, as was the case for the three tall male pilots. The district court’s narrow definition of “similarly situated” effectively removed Drerup from the proactive reach of antidiscrimination laws; the three pilots she identifies are proper comparators. . . . Drerup has furnished evidence that, as a woman whose stature prohibited her from flying a plane safely, she was treated worse than men whose stature prevented them from flying the same plane safely.” You can read a full copy of the opinion here.

06.21.2022 Judy Huth v. Bill Cosby – After a nearly three-week long trial, a Santa Monica jury found Bill Cosby liable for sexual battery of our client, Judy Huth. The sexual battery took place 47 years ago, in 1975, when Ms. Huth was only 16 years old. Ms. Huth alleged that she and a friend met Cosby at a park where he was shooting a movie in 1975, and that the actor subsequently led her and her friend to the Playboy Mansion where he had her perform a sex act upon him against her will. Court of Appeal upholds a jury award of $50 million in punitive damages to our client, Mahim Khan, against her former employer, Alki David

06.01.22 Metropolitan News – “Lascivious Acts Justify $50 Million Punitive-Damage Award.” The Court of Appeal has upheld a jury’s award of $50 million in punitive damages, along with $8 million in noneconomic compensatory damages, against film producer Alki David, heir to a Coca-Cola bottling fortune, based on his sexual battery and harassment of a woman who was a production assistant at two of his entertainment companies. Plaintiff, Mahim Khan, was represented by Nathan Goldberg, Dolores Y. Leal, and Renee Mochkatel of Allred, Maroko & Goldberg, along with Norman Pine and Scott Tillett of Pine Tillett Pine.

09.08.21 – Today a virtual press conference was held with attorney Gloria Allred and her partner, John West, to demand answers regarding the secret videotaping of high school girls as they were changing their clothes and were naked or partially naked in the girls’ restroom at Los Osos High School in Rancho Cucamonga, California. Ms. Allred and Mr. West now represent a large group of girls who are current or former students at the high school and who fear that their naked images may have been captured by the camera that was hidden in the girls’ restroom. Present and speaking with Ms. Allred at the virtual news conference today is one of the parents whose daughter may be one of the victims on the videotape.

Nathalie Fontanez v. City of Boston

AMG helped obtain a $3.2 million settlement on behalf of Nathalie Fontanez, a former Boston firefighter, who alleged she was sexually harassed by male colleagues while on the job, ostracized when she complained to her superiors, and sexually assaulted in a firehouse by a colleague. The colleague was later convicted of criminal charges. Ms. Fontanez also alleges that the City of Boston retaliated against her by denying her a better job after she reported the sexual harassment. Allred, Maroko & Goldberg Files Lawsuit Against Donald Trump

January 17, 2017 – AMG and co-counsel filed a lawsuit on behalf of Summer Zervos against now President Donald Trump for defamation. The lawsuit alleges that Mr. Trump subjected Ms. Zervos to unwanted sexual touching while she was a contestant on The Apprentice. In October, 2016, Ms. Zervos came forward to reveal her account of Mr. Trump’s sexual assault, as did other women, after seeing recordings from the set of “Access Hollywood” in which Trump made crude comments about grabbing women by the genitals. Trump then attacked these women. He said that their accounts were: “made up events THAT NEVER HAPPENED;” “100% fabricated and made-up charges;” “totally false;” “totally phoney [sic] stories, 100% made up by women (many already proven false);” “made up stories and lies;” “[t]otally made up nonsense.” He stated: “Every woman lied when they came forward to hurt my campaign, total fabrication. The events never happened.” We represent Summer Zervos in her suit against Donald Trump for these verbal, unfounded attacks. She wants to hold him accountable for his words and his actions, and to show that no matter how powerful the man, a woman’s voice matters.

AMG Fights for Transgender Man Denied Services at Long Beach Barbershop

In March 2016, Rose Trevis, a transgender man, was denied services from Hawleywood’s Barber Shop and Shaving Parlor in Long Beach, California. Multiple barbers at the shop told Rose that the shop would not provide services to Rose because “We do not cut women’s hair.” In addition, the barbershop’s website stated its policy of denying services to women declaring that the shop’s four locations were a “men’s sanctuary” and “one thing you won’t see at Hawleywood’s is women.” After AMG filed a lawsuit on behalf of Rose Trevis against Hawleywood’s for violating Rose’s civil rights, the barbershop settled the claim paying an undisclosed amount of damages and attorney’s fees.

As part of the settlement, the Court issued an injunction against Hawleywood’s barring the shop from refusing to serve customers based on their gender or perceived gender as well as an injunction against advertising that indicates a policy of refusing to provide services or accommodations based on an individual’s gender or perceived gender. Following the lawsuit, Hawleywood’s website was changed to read: “Hawleywood’s Barber Shop attracts people from all walks of life.”

Another Large Verdict on Behalf of our Client!

June 2015 – O’Brien v. Baca. A jury awarded $1,325,000 to our client, a pregnant woman who was fired after she filed for unemployment benefits based on her reduction in hours. The plaintiff in the case earned $15 an hour and had been employed for less than a year. The jury awarded $325,000 in compensatory damages and $1 million in punitive damages. Nathan Goldberg was lead counsel for our client.

Partner Gloria Allred Sworn in as Member of the New York Bar

Women’s rights attorney Gloria Allred was sworn in today, Sept. 25, 2013, as a member of the New York Bar. Ms. Allred, who has been a practicing attorney in California for 38 years and who is a partner in the Los Angeles law firm of Allred, Maroko & Goldberg, took the oath this morning.

Presiding Justice Karen K. Peters administered the oath to Ms. Allred at the Robert Abrams Building for Law and Justice in Albany, New York. Justice Peters became the first woman to serve as a presiding justice of the Appellate Division of the Supreme Court of New York for the Third Judicial Department when appointed by Gov. Andrew Cuomo in April 2012.

“I am honored to be licensed to practice law in the state of New York and to be a member of the New York Bar,” Ms. Allred said. “I look forward to asserting, protecting and vindicating the legal rights of women and minorities in New York and assisting them in their right to enjoy equal protection under the law.”

Another Huge Verdict for Our Clients!

On June 23, 2013 – AMG represented three plaintiffs, Elizabeth Pop, Victor Zavala, and Ian Vloke-Worth who worked as janitors for less than three months at Pasadena City College ( Pop et al. v. Pasadena Area Community College District). Plaintiffs alleged that all three had been fired after they complained that their supervisor was mistreating Ms. Pop based on her gender. Nathan Goldberg and Christina Cheung tried the case together. Jurors agreed with the retaliation claims for two of our clients and awarded them a combined verdict of $600,000. AMG was awarded close to $1 million in attorneys’ fees for the thousands of hours they poured into the case.
